OPLIX NEXGEN HOSPITALITY PTY LTD
CORPORATE, EDUCATION, CONFERENCE & EVENT CATERING TERMS AND CONDITIONS
1. Application
These Terms and Conditions apply to all catering orders placed with Oplix NexGen Hospitality Pty Ltd through Flexischools, online ordering platforms, email, telephone or any other approved ordering method.
By placing an order, the Customer confirms they are authorised to act on behalf of the organisation, school, university, government agency, business or event organiser making the booking.
2. Catering Services
Oplix NexGen Hospitality provides catering services including:
- Staff meetings
- Professional Development Days
- Conferences
- Training sessions
- School Council meetings
- Board meetings
- Parent Information Evenings
- Graduation ceremonies
- Corporate functions
- Education sector events
- Community events
- Hospitality and VIP functions
All catering services are subject to availability and acceptance.
3. Quotations and Pricing
All quotations are valid for seven (7) days unless otherwise stated.
Prices are quoted in Australian Dollars (AUD) and include GST unless expressly stated otherwise.
Oplix NexGen Hospitality reserves the right to amend pricing where:
- Guest numbers change;
- Menu selections change;
- Delivery requirements change;
- Venue requirements change;
- Supplier costs materially increase.
4. Confirmation of Orders
An order is not confirmed until:
Written acceptance is received;
- A Purchase Order is received where applicable;
- Payment arrangements have been agreed; and
- Oplix NexGen Hospitality issues confirmation.
- The Customer is responsible for ensuring all event details are accurate.
4A. Minimum Catering Order Value
A minimum catering order value of $220.00 (including GST) applies per delivery location unless otherwise agreed in writing.
Orders below the minimum value may incur a delivery, administration and handling fee determined at the time of booking.
Oplix NexGen Hospitality reserves the right to decline orders that do not meet the minimum order requirement.
4B. Final Attendee Numbers
Final attendee numbers must be confirmed no later than forty-eight (48) hours prior to the scheduled delivery or event commencement time.
The confirmed attendee numbers shall be deemed the minimum quantity to be prepared, supplied and invoiced.
Reductions after the final confirmation deadline will not reduce the invoiced amount.
Increases after the final confirmation deadline will be accommodated where reasonably practicable but cannot be guaranteed and may attract additional charges.
4C. Purchase Order and Internal Approval Responsibility
Where a Customer operates under a purchase order, procurement, budget approval or internal authorisation process, such processes remain solely the responsibility of the Customer.
Failure to obtain internal approvals or purchase order numbers does not relieve the Customer of responsibility for payment of catering services ordered, prepared or supplied.
Any person placing an order warrants that they have authority to bind the organisation they represent.
4D. Venue Access and Delivery Conditions
The Customer must provide safe and reasonable access for delivery personnel.
The Customer must advise of:
- Security procedures;
- Restricted delivery windows;
- Parking restrictions;
- Loading dock requirements;
- Lift access requirements;
- Multiple delivery locations;
- Campus access requirements;
- After-hours access requirements.
Additional charges may apply where delivery requires:
- Extended waiting times;
- Multiple delivery points;
- Site inductions;
- Security clearances;
- Excessive walking distances;
- Stair-only access;
- Additional labour resources.
4E. Equipment and Catering Assets
All reusable platters, display equipment, insulated containers, serving equipment and catering assets remain the property of Oplix NexGen Hospitality unless otherwise agreed.
The Customer is responsible for any loss, theft, damage or replacement costs associated with such equipment while under their control.
Additional collection fees may apply for equipment not available for collection at the agreed time.
4F. Education Sector Catering
For education sector customers including schools, colleges, universities and training organisations:
- Catering quantities are prepared specifically for confirmed attendee numbers.
- Last-minute cancellations may result in unrecoverable food, labour and procurement costs.
- Oplix NexGen Hospitality may recover reasonable costs incurred prior to cancellation.
- Event organisers remain responsible for communicating dietary requirements, venue logistics and attendee changes within the required notice periods.
5. Minimum Notice Period
Unless otherwise agreed:
- Standard catering orders require a minimum of 48 hours notice.
- Functions exceeding 100 attendees may require five (5) business days notice.
- Functions exceeding 250 attendees may require a separate Catering Services Agreement.
6. Dietary Requirements and Allergens
Customers must advise dietary requirements and allergens at the time of ordering.
Whilst every reasonable effort is made to accommodate dietary requirements, food is prepared in commercial kitchens where allergens including nuts, dairy, eggs, gluten, soy, sesame and seafood may be present.
Oplix NexGen Hospitality cannot guarantee an allergen-free environment.
Cross-contamination may occur despite reasonable precautions.
The Customer remains responsible for communicating dietary requirements accurately.
7. Delivery and Service
Delivery times are estimates only.
Risk in the goods passes to the Customer upon delivery to the nominated location, reception area, meeting room or authorised representative.
The Customer is responsible for ensuring food is consumed and stored in accordance with food safety requirements after delivery.
8. Customer Responsibilities
The Customer must provide:
- Suitable delivery access;
- Appropriate service facilities where required;
- Adequate refrigeration where applicable;
- A contact person available during delivery.
9. Cancellations
All cancellations must be submitted in writing.
Cancellation fees are intended to reflect procurement, labour, administration and food preparation costs already incurred.

Special-order products, customised menu items and externally sourced products may be charged in full once procurement has commenced.
10. Payment Terms
Unless otherwise agreed:
- Payment is due at the time of ordering; or
- Approved account customers shall pay within fourteen (14) days of invoice date.
Late payments may incur administration charges, collection costs and interest as permitted by law.
11. Force Majeure
Neither party shall be liable for failure to perform its obligations where such failure results from events beyond reasonable control, including:
- Natural disasters;
- Government restrictions;
- Public health emergencies;
- Industrial disputes;
- Utility failures;
- Supply chain interruptions;
- Transport disruptions.
Where possible, Oplix NexGen Hospitality will work with the Customer to reschedule services.
12. Limitation of Liability
To the maximum extent permitted by law:
(a) Oplix NexGen Hospitality's liability is limited to the value of the affected order;
(b) Oplix NexGen Hospitality is not liable for indirect, consequential or economic loss;
(c) Remedies are limited to replacement, resupply or refund of the affected catering services.
Nothing in these Terms excludes rights under the Australian Consumer Law.
13. Indemnity
The Customer indemnifies Oplix NexGen Hospitality, its directors, employees and contractors against claims arising from:
- Incorrect information supplied by the Customer;
- Failure to disclose dietary requirements;
- Improper storage or handling of food after delivery;
- Acts or omissions of the Customer, its employees, contractors or guests.
14. Intellectual Property
All menus, recipes, concepts, pricing schedules, branding and marketing materials remain the intellectual property of Oplix NexGen Hospitality Pty Ltd.
15. Privacy
Personal information collected in connection with catering services will be used solely for:
- Order administration;
- Service delivery;
- Customer communications;
- Food safety management;
- Regulatory compliance.
16. Amendments
Oplix NexGen Hospitality reserves the right to amend these Terms and Conditions from time to time.
Updated Terms become effective upon publication on the ordering platform.
17. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia.
The parties submit to the exclusive jurisdiction of the Courts of Victoria.
